HUD Delays Effective Date for Revocation of 30-Day Notification Requirement for PHAs and PBRA

HUD will publish an interim final rule in tomorrow’s Federal Register that indefinitely postpones the effective date of the interim final rule revoking the 30-day notice requirement before terminating a lease for nonpayment of rent. The interim final rule, originally published on February 26, 2026, had been scheduled to take effect on March 30, 2026. HUD will instead treat the measure as a proposed rule, meaning it will only take effect after the agency reviews public comments and issues a final rule. HUD cited recent litigation challenging the interim final rule as the reason for the delay.
The rule proposes to restore HUD’s regulations on lease termination notices for nonpayment of rent to the framework that existed prior to the 2021 interim final rule. Under the proposal, provisions requiring public housing agencies (PHAs) and property owners to include certain information in termination notices to tenants would be removed. It would also eliminate language that prohibited PHAs and owners from issuing a termination notice before the day after rent is due under the lease. The deadline for submitting public comments—April 27, 2026—remains unchanged.
